This Service Disclaimer (“Disclaimer”) governs the limitations of liability, warranties, and representations concerning the use of services provided by MA Digiworld (“Company,” “we,” “our,” or “us”). By engaging with MA Digiworld’s services, including but not limited to Digital Marketing, Website Development, Content Creation, Strategy Consulting, Graphic Design, and UI/UX Design, the Client (“you,” “your,” “user”) agrees to the terms set forth herein.
1. NO GUARANTEE OF SPECIFIC RESULTS
1.1: Marketing Outcomes
While MA Digiworld employs industry-standard practices and data-driven strategies to achieve optimal results, we make no express or implied guarantees regarding the success, profitability, visibility, engagement rate, sales conversions, or search engine ranking improvements resulting from the services provided.
1.2: Third-Party Platform Performance
The performance of campaigns executed on third-party platforms (such as Facebook/Meta, Google, Instagram, TikTok, etc.) is subject to various factors beyond our control, including but not limited to platform algorithm changes, advertising policy changes, account restrictions, bidding competition, audience behavior, and market conditions.
2. CLIENT RESPONSIBILITIES
2.1: Access and Materials
MA Digiworld shall not be held liable for delays, suboptimal performance, or project interruptions caused by the Client’s failure to provide necessary information, approvals, login credentials, or materials in a timely manner.
2.2: Accuracy of Content
It is the Client’s sole responsibility to ensure the accuracy, lawfulness, and originality of all content, logos, and data provided to MA Digiworld. We shall not be liable for any copyright violations, misinformation, or legal disputes arising from Client-supplied content.
3. LIMITATION OF LIABILITY
3.1: Indirect Damages
To the maximum extent permitted by applicable law, MA Digiworld shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, goodwill, data, or business opportunities, whether based in contract, tort, or otherwise.
3.2: Service Interruptions
We do not warrant that our services will be uninterrupted, error-free, or immune from unauthorized access. While we take all reasonable steps to ensure security and continuity, occasional technical interruptions may occur due to maintenance, updates, or external service provider failures.
4. THIRD-PARTY TOOLS AND INTEGRATIONS
MA Digiworld may, at the Client’s request or as part of a strategy, integrate or use third-party tools, plugins, APIs, or platforms. The Client understands that such tools are governed by their own terms and privacy policies, and MA Digiworld disclaims any liability arising from their use, including data loss, pricing changes, or service downtime.
5. INTELLECTUAL PROPERTY RIGHTS
All intellectual property developed by MA Digiworld (including but not limited to designs, strategies, content, and software) remains the property of MA Digiworld until full payment is received. Upon full settlement, ownership of approved deliverables may be transferred to the Client, subject to mutual agreement and licensing terms.
6. DISCLAIMER OF WARRANTIES
All services provided by MA Digiworld are offered “as is” and “as available,” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access.
7. JURISDICTION AND GOVERNING LAW
This Disclaimer shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising in connection with this Disclaimer shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.
8. MODIFICATIONS TO THIS DISCLAIMER
MA Digiworld reserves the right to amend, update, or modify this Disclaimer at any time without prior notice. The revised version shall be published on our website and shall become effective immediately upon posting. Continued use of our services constitutes your acceptance of such modifications.
9. WORKING HOURS AND EMERGENCY SUPPORT
MA Digiworld operates standard service delivery hours between 10:30 AM and 9:30 PM (PKT) for domestic clients, and the same 10:30 AM to 9:30 PM window adapted to the respective local time zone for international clients. While standard project execution and communications are managed during these hours, MA Digiworld offers 24×7 emergency support to address critical failures, system outages, or urgent matters that may disrupt ongoing services. Clients are advised to use the emergency contact channels only for situations of such nature.
